Change in the apportionment of collective contracts to the additional rental costs regarding the free choice of television

Traditionally, many landlords have entered into collective agreements with cable network operators to provide tenants with access to cable television. The costs for this were often passed on to tenants as part of the operating costs. The Telecommunications Modernization Act (TKMoG), which came into force on July 1, 2024, prohibited the passing on of cable fees as operating costs. These changes aim to strengthen tenants' rights and increase transparency and freedom of choice.

Practical implications for tenants:

  • Tenants who do not use or prefer cable television will no longer be forced to pay the fees.
